liberty county judge phil fitzgerald has entered into what is called an agreed order assessing administrative PENALTIES for ENVIRONMENTAL violations at his personal equipment yard at the corner of state highways 146 and 105 in moss hill. the agreement between phil fitzgerald and the texas commission on environmental standards is on the tceq board agenda for final approval on june 30. according to both the settlement documents and phil fitzgerald, he has not admitted wrongdoing.

as part of this settlement with tceq, Phil Fitzgerald has AGREED to a $1,250 ADMINISTRATIVE PENALTY. however, $250 of that is DEFERRED and will be waived once phil fitzgerald complies with the agreed terms. a tceq violation SUMMARY chart says fitzgerald failed to perform what is called a response SOLUTION upon detection of used oil on the ground. That means the oil was not cleaned up properly. it also cites a failure to prevent unauthorized disposal of 350 cubic yards of construction and demolition waste, tires, treated lumber, household garbage, SHINGLES, vegetative material, tarpaulin, metal, wood waste and ELECTRICAL equipment. documents show the tceq investigation began with an ANONYMOUS complaint. phil fitzgerald said this is not the first accusation lodged with tceq against him in recent months, but it is the only one where any action has been taken.

tceq documents state there is no additional pending enforcement actions regarding this facility. the agreed order requires that phil fitzgerald no longer use the site for waste disposal. it also REQUIRES removal of all wastes and contaminated soils. phil fitzgerald said that clean-up is already complete.

as stated earlier in this story, phil fitzgerald said the agreed order is slated for tceq board approval on june 30, but he agreed to the terms back in april.

so, following an anonymous COMPLIANT, the texas commission on environmental standards inspected phil fitzgerald’s equipment yard at the corner of state highways 146 and 105. now, the liberty county judge has signed an order agreeing to pay an ADMINISTRATIVE ASSESSMENT of $1,000 and clean up his facility. phil fitzgerald said those two requirements have already been met. now, the tceq board is set to approve this agreement on june 30.

another reminder - those behind the efforts to start a liberty community garden will hold an organizing meeting tomorrow at 5:30 p.m. in the liberty county annex on cos street. this meeting is open to anyone interested in participating in the new community garden idea. kshn has previously reported on efforts to ORGANIZE a liberty community garden on the grounds of the old san jacinto ELEMENTARY school at the corner of texas and grand avenue. the idea of the community garden is being pushed hard by local state farm agent tracy williams. she is the incoming liberty rotary club president, but the concept has grown to include texas agrilife extension service, the liberty county master gardeners, the liberty garden club, liberty isd and other local groups. plans for the garden call for numerous plots that individuals or groups could rent, for a small fee, to grow vegetables, flowers and other plants. tracy williams said the community garden also could become a great LEARNING experience for local kids since each liberty school could have its own plot. once more, there will be an organizing meeting for the liberty community garden tomorrow at 5:30 p.m. at the liberty county annex, 2013 cos street in liberty. anyone interested in PARTICIPATING is invited. for information, call the extension office at 936-336-4558, ext. 221.

MARK YOUR CALENDARS – THE DAYTON CHAMBER OF COMMERCE HAS RESCHEDULED ITS hunting and fishing expo. ORIGINALLY PLANNED FOR JULY 10, THIS OUTDOOR EXTRAVAGANZA IS NOW SET FOR SATURDAY, AUGUST 21, AT the new dayton community center. THE DEADLINE FOR VENDOR SPACES HAS ALSO CHANGED FROM THIS FRIDAY TO AUGUST 6. dayton chamber president tammy pratka said they will have exhibitor booths that highlight the hunting and fishing industry.

this is something new for the dayton chamber. tammy pratka said it will take the place of their hometown holiday event HELD in december DURING RECENT YEAS. THE HUNTING AND FISHING EXPO is meant to promote this area.

THE EFFORTS OF A CHAMBERS COUNTY SHERIFF’S DEPARTMENT EMPLOYEE AND THE PARTICIPATION OF THE "AMERICA’S MOST WANTED" TELEVISION SHOW HAVE REINVIGORATED A MURDER INVESTIGATION THAT HAD GONE COLD. ON APRIL 27TH, 2007, THE BODY OF A MURDERED HISPANIC MALE WAS FOUND FLOATING IN DOUBLE BAYOU. CHAMBERS COUNTY SHERIFF’S DEPARTMENT INVESTIGATORS FOLLOWED EVERY LEAD AND EXAMINED EVERY PIECE OF PHYSICAL EVIDENCE AVAILABLE BUT THE VICTIM COULD NOT BE IDENTIFIED. SEARCHES THROUGH DNA AND FINGERPRINT DATA BASES TURNED UP NOTHING.
